Have They No Shame?
Holding Insurers Accountable for Bad Faith Claim Denials
If you have paid your premiums, an insurance company has a duty to hold up its end of the agreement. But some insurers use deception and technicalities to avoid paying out on legitimate claims.
Foshee & Yaffe doesn't let the insurance companies get away with it.
Our knowledgeable trial lawyers are experienced in insurance bad faith litigation. Located in Oklahoma City, we represent individuals and businesses throughout western Oklahoma that are unjustly denied coverage when it is needed most. Call us at 1-866-610-8106 for a free case evaluation.
What Constitutes Insurance Bad Faith?
- Refusal to honor a claim against the policy — An insurance claim is denied for auto liability or uninsured/underinsured motorist coverage. The insurer insists that you are an excluded party, had a pre-existing condition or that it doesn't rate your injury severe enough to pay the policy limits. This also applies to a health insurance, life insurance, private disability, commercial liability or homeowner's policy.
- Failure to defend you against a loss — You are sued for causing a car wreck, for example, but the carrier does not defend you, and a judgment is entered against your personal assets. We also represent businesses whose insurer won't provide a defense against lawsuits.
Sometimes the involvement of a lawyer is enough to convince the insurer to make good. When necessary, we will go to trial to prove that the insurance company acted in bad faith. We have prevailed against even the largest insurers.
Our attorneys closely examine the claims file for evidence of bad faith, and take depositions of claims adjustors and supervisors. Did the insurance adjuster act contrary to the policy or contract? Was the rejected claim reviewed by anyone higher up the chain? If there was a defense medical evaluation (DME), did the insurer pick and choose the parts that supported their denial?
A Success Story: We represented a doctor who could no longer perform his physician duties because of a brain tumor. His insurance carrier denied his private disability claim, contesting the severity of the tumor. We recovered a large confidential settlement after bringing a bad faith insurance lawsuit.
Damages for bad faith can include payment of the disputed amount, attorney fees and punitive damages. Contact Foshee & Yaffe for a free initial consultation about your insurer's non-payment. We take no attorney fees unless we recover compensation for you.
