CLASS ACTION AND MULTI-DISTRICT LITIGATION

Personal Injury
Under Oklahoma Law, if someone is injured due to the actions of another, the injured person is entitled to recover damages. Damages include medical expenses, loss of income, pain and suffering, disfigurement, disability and other elements of damage that the injured person can prove.
In order to recover damages for personal injury an individual must prove:
A. that the other person acted negligently (for example, ran a red light) or intentionally (assault and battery), and
B. that those actions were the cause of the individual's injuries.
Wrongful or Accidental Death
If someone dies as a result of the actions of another such as listed in the categories on Personal Injury, Medical Malpractice and Products Liabilities, the next of kin and heirs are entitled to recover damages. The legal term for this type of action is "accidental death" or "wrongful death".
Under Oklahoma Law, the elements of damages for death of a minor child are different then the elements of damages for the death of an adult. Also, additional damages may be recovered if the deceased experienced conscious pan and suffering prior to death as opposed to being killed instantly.
Workers Compensation
Workers Compensation is the body of law that helps people get the necessary benefits for injuries received while on the job. Under Oklahoma Law, you are entitled to four basic benefits if you are injured on the job.
The first benefit is medical care, which is the right to all reasonable and necessary medical treatment related to your injury, and which has to be paid by the employer or the insurance company. If you are unable to work during the period of time that you are receiving medical treatment, then you are entitled to a temporary total disability benefits which is 70% of your average weekly wage up to a maximum amount. If you are left with permanent problems, the Court will compensate you for a percentage of disability to the injured body part. Finally, if you are unable to work because of your injury, you can apply for and receive vocational rehabilitation, which is job retraining.

Medical Malpractice
In order to recover damages for medical malpractice, an individual must prove that he was injured (see personal injury) by the negligence of a physician or other healthcare provider. That individual must prove:
A. the physician or the healthcare provider rendered treatment below acceptable standards of care and,
B. that the injuries were directly caused by such sub-standard medical care.
Criminal Litigation
The Law Firm of Foshee & Yaffe handles all aspects of Criminal Defense Litigation ranging from a simple speeding ticket to more severe charges such as driving under the influence, rape and even murder defense. Furthermore, be advised that the criminal defense that this law firm provides not only includes state crimes but also federal crimes as well.
Appeals
Under our laws governing Appeals, a court decision may be overturned by the Court of Appeals or the Supreme Court only if the lower court commits "reversible error" in ruling during the pre-trial and/or trial of the case. An individual who is dissatisfied by the decision of a lower court must carefully consider the expense involved and the chances of a successful appeal.
Bankruptcy
Generally, any dispute other than a criminal case which is submitted to the Courts for determination is included in the category of Civil Litigation. The types of disputes are numerous and varied involving personal injury, real estate, insurance, contracts, purchases and many other types of disputes. Just because a dispute is filed in court doesn't mean it will go all the way to trial. Many cases are settled by the parties after a lawsuit is filed or are submitted to Mediation or Arbitration. Some cases do proceed to trial with some types being submitted to a jury for a determination and some types of cases are decided by a Judge.
Debtor & Creditor Rights
The law of Debtor and Creditor Rights is defined as protection from unlawful debt collection and collection of legal debts and obligations.
Examples:
A. Collection of debt owed to you from person you sold automobile to.
B. Protection from collection of debt of unsolicited (telephone) telemarketing or unauthorized use of your credit card.

Estate Planning
Estate Planning deals with providing for your family through Wills and Trusts. By providing a Will or Trust you make the decision of what happens to your assets, rather than someone else.
Insurance Casualty
Most personal injury cases involve insurance casualty law. For example, in the case of someone injured in an automobile accident, the negligent driver should maintain a policy of liability insurance to compensate the injured person for his or her damages.
There are many cases, however, where an individual may have a direct claim against his own insurance company for medical payments, uninsured motorist, underinsured motorist or other types of coverage.
There is also a cause of action under Oklahoma law for "bad faith" which may be raised when an insurance company fails in it's duty to deal fairly and in good faith with it's insured (the customer who purchases insurance).
Probate
Probate is the process that transfers assets after someone dies.
Product Liability
In order to recover damages under the legal theory of products liability an individual must prove he has suffered damages (see personal injury) and that his damages were caused by the manufacturer and sale of a defective product which was unreasonably dangerous to users of the product. It must also be proven that the product was defective when purchased and hadn't been altered or modified, and that the injuries were directly caused by the defect in the product.
Examples:
A. tire manufacturers selling defective tires that cause tread separation and vehicle rollover,
B. Ladder breaks while using it.
Social Security Disability
Social Security Disability is for individuals who are unable to work due to an disability.
This benefit is also available for children if the disability is extremely severe.
Discrimination or Wrongful Termination
The Law Firm of Foshee & Yaffe has recently expanded our areas of practice to include discrimination and wrongful discharge. Discrimination deals with race, gender, disability, religion and age. Wrongful discharge deals with the termination of the employee by an employer without a justifiable reason.
